INFORMATION TO CUSTOMERS AND SUPPLIERS – EX ART. 13 EUROPEAN REGULATION
In compliance with the Regulation relating to the protection of natural persons with regard to the processing of personal data, as well as the free circulation of such data (EU Regulation of the European Parliament and of the Council of 27 April 2016, n. 2016/679/EU – GDPR) , Data of the data controller.
1. Data Controller
Data of the data controller: Flats Service s.r.l., Via Setta, 5 – 40037 Sasso Marconi (BO), P.I. 02032091205, info@flats-service.com as “Data Controller”, provides you with this information as “Data Controller” of the personal data concerning you pursuant to articles. 13 and 14 of the aforementioned Regulation.
Data processed: data relating to personal details, identification data of the natural persons who collaborate and interact with the Data Controller by virtue of the contractual relationship in place with the same, contact data such as telephone number, personal or general email of the department, addresses, accounting, financial, administrative, banking data, as well as any necessary information provided by you necessary for the completion of the contract.
2. Purpose of processing and legal basis
The personal data provided by you will be processed for purposes related to the execution of the contract, including any pre-contractual phase and, precisely, for the compilation of personal data lists, bookkeeping, invoicing, carrying out communications both by paper and electronic, tax obligations, organizational management of the requested services and stipulation of contracts, setting of appointments, order processing, deliveries, bureaucratic obligations relating to the services requested in the supply relationship. The Data you provide is processed for the following purposes:
a) for the fulfillment of the contractual obligations deriving from the contract signed with you and for the protection of the contractual rights of the Data Controller. Legal basis of the processing is the contractual relationship as provided for by the art. 6 lett. b) European Reg.;
b) for the fulfillment of the legal obligations established by the legal regulations for the requirements established by the fiscal and tax legislation. Legal basis of the processing is the contractual relationship as provided for by the art. 6 lett. c) European Reg. The provision of data is mandatory, the refusal to provide the data or the complete opposition to their processing for the purposes referred to may in any case make it impossible to conclude the contractual relationship with you.
3. Recipients of the data
Furthermore, your data may be communicated to third parties, for technical and operational needs strictly connected to the purposes set out above and in particular to the following categories of subjects:
a) bodies, professionals, companies or other structures appointed by us for processing related to the fulfillment of administrative, accounting and management obligations linked to the ordinary performance of our economic activity, also for credit recovery purposes;
b) to public authorities and administrations for purposes related to the fulfillment of legal obligations or to subjects entitled to access them pursuant to provisions of law, regulations, community legislation;
c) banks, financial institutions or other subjects to whom the transfer of the aforementioned data is necessary for the performance of our company’s activities in relation to the fulfillment, on our part, of the contractual obligations assumed towards you.
d) suppliers of installation, assistance and maintenance services of IT and telematic systems and systems and of all services functionally connected and necessary for the fulfillment of the services covered by the Contract. The list of data controllers is available upon request.
4. Data retention times
We will keep your data in a form that allows identification of the same for a period of time not exceeding the achievement of the purposes for which the data were collected; they will therefore be kept until the existence of the existing contractual relationship and no later than 10 years from the termination of the contract (art. 2946 of the civil code regarding prescription). The data strictly necessary for tax and accounting obligations, once the purpose for which they were collected ceases to exist, will be retained for a period of 10 years as established by the art. 2220 c.c.
5. Data transfer
The Data Controller does not transfer personal data to third countries or to international organisations.
6. Rights of the interested party
At any time, interested parties have the right to access their personal data, to request rectification, updating and relative deletion. It is also possible to oppose the processing and request its limitation. Furthermore, in the event that it is believed that the processing has been carried out in violation of the legislation on the protection of personal data, the right to lodge a complaint with the Guarantor Authority for the protection of personal data, Piazza Venezia, 11 – 00187 – Rome. The interested party may exercise the rights at any time by sending a registered letter with return receipt to Flats Service s.r.l., Via Setta, 5 – 40037 Sasso Marconi (BO) or an e-mail to info@flats-service.com.
